This video is about the New York DWI refusal case and the consciousness of guilt jury instruction. If you refuse the police request to give a sample of your breath, blood, or urine you will be marked as a DWI refusal.

What that refusal triggers are two main punishments:

a license revocation of one year (and a hearing on that) and
a judge's instruction to a jury that the reason for your refusal was that you had a guilty conscious.

Why is this so bad?

Because in most states judges can't comment on the strength or weakness of the evidence. In New York judges are allowed to comment on the evidence of your refusal and what the jury can infer from that behavior.
