WHAT DOES Q-D-R-O STAND FOR?
a. A Q-D-R-O or QDRO is a Qualified Domestic Relations Order.

b. It’s a specialized order required for the division of a pension.

2. WHEN WOULD I NEED A QDRO?
a. If you are going though a divorce or separation, and either spouse is a member of a union, or works for the government, is in the military, or works for a company that provides any retirement or savings plan like a 401(k), 403(a), or 403(b), a QDRO or other kind of pension division order is probably needed.

b. Not every retirement account requires a QDRO – for example, Individual retirement accounts, or IRAs, do not need a QDRO.

3. DO GOVERNMENT PENSIONS REQUIRE A QDRO?
a. Government pensions are divisible but require other kinds of special orders.

b. For instance a federal government pension is divided by a Court Order Acceptable for Processing or COAP.

c. A military pension is divided using a Military Benefits Division Order or MBDO, or “Order Incident to Decree.”

d. Nevada PERS requires a special form of order as well, called a QDRO, but governed by different statutes.

e. If you’re not sure, you should ask an expert whether a QDRO is necessary, and if so what kind.


4. BOTH MY WIFE AND I HAVE A 401(k). IF WE GET DIVORCED, WOULD WE NEED TWO QDROS?
a. Not necessarily. If we know the cash balance of each plan, it is possible for us to balance the two 401(k)s so that you will only need one order.

5. WILL THE QDRO DEAL WITH SURVIVOR BENEFITS IN CASE SOMEONE DIES?
a. It certainly can, and should. Survivor benefits are often very complicated and must be reviewed on a case-by-case basis.

b. We recommend that you consult with a specialist in retirement benefits to be sure you know what benefits are available, who is eligible to receive them, and who should pay for them.

6. THIS SEEMS TO BE VERY COMPLICATED. WHY IS IT NECESSARY?
a. In most cases, the retirement is the single most valuable asset of the marriage. Since in Nevada we divide marital property equally, it is extremely important to consider te pensions in any divorce.
