Hello, my name is Jason Roth. I am an attorney with the law firm of Roth Davies in Overland Park, Kansas. A question that I get frequently is, “what is a commercial motor vehicle? Is it a truck? Trailer? A box truck? A pick-up truck?” According to the Federal Motor Carrier Safety Regulations, a commercial motor vehicle is any self-propelled or towed motor vehicle used on a highway in interstate commerce to transport passengers or property. To be considered a commercial motor vehicle, the vehicle must satisfy at least one of the following criteria: have a gross vehicle weight rating, gross combination weight rating, gross vehicle weight, or a gross combination weight of 10,001 pounds of more or whichever is greater, or be designed or used to transport 9 or more passengers, including the driver, for compensation, or be designed or used to transport 16 or more passengers, including the driver, not for compensation, or finally to be used to transport hazardous materials in quantities requiring the vehicle to have some sort of display posted that indicates to other drivers that they are carrying hazardous materials. The Federal Motor Carrier Safety Administration specifically defines the terms “motor vehicle” and “highway” both of which are found in the definition of a commercial motor vehicle. It is no worthy to mention that the commercial motor vehicle definition includes combinations of vehicles that by themselves may not be regulated. For example, a pick-up truck that weighs less than 10,000 pounds could be considered a commercial motor vehicle and subject to the federal regulations if it is pulling a small trailer that puts it over the 10,000-pound mark.
