Dowry Death in India: Legal Provisions and Social Implications
Introduction
Dowry death is a serious social and legal issue in India, where women are harassed, tortured, or even killed due to unmet dowry demands. Despite legal frameworks aimed at curbing this practice, dowry-related violence persists in many parts of the country.

1. Legal Framework
a) Section 304B of the Indian Penal Code (IPC) – Dowry Death
This section defines dowry death and prescribes punishment.
If a woman dies under unnatural circumstances within seven years of marriage, and it is proven that she was subjected to cruelty or harassment by her husband or in-laws for dowry, the husband or relatives can be imprisoned for at least 7 years, which may extend to life imprisonment.
b) Section 498A IPC – Cruelty Against Women
This section criminalizes mental and physical cruelty inflicted by the husband or his relatives on a woman, particularly related to dowry demands.
Punishment includes imprisonment up to 3 years and a fine.
c) The Dowry Prohibition Act, 1961
Prohibits the giving and taking of dowry before, during, or after marriage.
Violators may face imprisonment of 5 years and a fine of ₹15,000 or the value of the dowry, whichever is higher.
2. Judicial Interpretations and Landmark Cases
Shanti v. State of Haryana (1991) – The Supreme Court held that circumstantial evidence can be used to convict the accused under Section 304B IPC.
Satbir Singh v. State of Haryana (2021) – Reinforced
