David L. Fleck represents businesses in matters involving fraud, privacy and cybersecurity.
Mr. Fleck prosecuted felonies and complex financial crimes for the Los Angeles District Attorney's Office from 1999 until 2009. His cases included white collar criminal enterprises involving investment fraud, identity theft, money laundering, and loan fraud. Now he represents business owners (often foreign business owners who do business in California) whose former business partners cheated them using some kind of fraud. He has represented clients from China, Vietnam, Mexico, Peru, Israel, Lebanon, Jordan, Hungary, Romania, Armenia and the Ukraine as well as numerous domestic business owners.
To assist his clients in this era of big data and privacy breaches, he can consult with and advise companies on their responsibilities under California and U.S. data protection and privacy laws. Mr. Fleck can help U.S. companies obtain certification under and comply with the US-EU Safe Harbor program for data sharing. He can help companies evaluate their risks, develop prevention and response protocols, and draft a Privacy and Cyber Security Handbook. Finally, if there is a breach, he can help companies navigate the minefields of litigation either as litigation counsel himself or by managing litigation counsel.
When necessary, Mr. Fleck can provide legal and compliance training to his clients and their employees. His interactive teaching style leaves audiences asking for more. He honed his instructional skills as a college professor where he taught paralegals about civil litigation. Mr. Fleck has provided training and presentations to diverse audiences that include fraud detectives, the Mortgage Bankers Association, the International Association of Financial Crimes Investigators, the American Conference Institute, the Federal Mortgage Fraud Working Group, Fannie Mae, the National Notary Association, the Securities and Exchange Commission (SEC), the Federal Deposit Insurance Corporation (FDIC), and three major financial institutions including one of the big four banks. He helped develop a class that is currently used to teach detectives how to investigate mortgage loan fraud.
Mr. Fleck loves to travel to his clients' homelands, taste their traditional foods, and enjoy local coffee, beer and wine. However, despite his clients' best efforts, I does not consume "hard" alcohol like whiskey, tequila and vodka.
