The Permanent Court of Arbitration (PCA) in The Hague has no right of arbitration over territory disputes and its involvement in the South China Sea dispute may cause global tension, said an Italian expert in an exclusive interview with China Central Television (CCTV) on Friday.

Domenico Losurdo, emeritus professor of University of Urbino, said China always insists on bilateral negotiations when solving problems and have made great advancements in resolving border disputes.

"I've done some research in regards to this and have written it in my books. China has some territory disputes with its neighboring countries. But China resolved all the disputes through bilateral negotiations. China has made great progress to solve these territory disputes," said Losurdo.

Losurdo said the arbitration initiated by the Philippines is illegal and invalid and the PCA has no rights and jurisdiction towards this dispute.
"There are double illegalities. The PCA has no function within this situation and it could be ruled as 'power abuse' according to the law. Moreover, the Philippines concealed the [essence of] sovereignty disputes over the related islands and used other excuses when submitting the arbitration application to the PCA," said Losurdo.

Losurdo said China's neither accepting nor involving itself in the arbitration which is a reasonable and legal move. He said the result of the arbitration may trigger uncertain factors in terms of world peace.

"I'm afraid if the PCA's arbitration result supports the Philippines [appeal], it'll be harder for China and the Philippines to reach a settlement. But the US could tighten its policy based on the result. There will be legal guise for a large amount of U.S. military presence in the South China Sea. I hope the PCA judges would consider this carefully. This arbitration may cause global tension," said Losurdo.

PCA in The Hague said on June 29 that, it will issue an award on July 12 on the South China Sea case unilaterally initiated by the Philippines. More on: http://www.cctvplus.com/news/20160706...
