In Jefferson County Court, Judge presided over the case of Michelle Lee Cormier, charged with first-degree felony murder under cause number 25DCCR0153. The charge stems from allegations that Cormier knowingly delivered fentanyl to another inmate, Shelby Irvin, leading to Irvin’s fatal overdose while in custody.

Defense attorney Mr. Radford filed a motion to quash the indictment, arguing that the indictment failed to allege the necessary mens rea (criminal intent) required for murder. He contended that under common law, murder demands an intentional and knowing act, not merely a knowing one. The prosecution, however, argued that under Section 19.02(b)(4) of the Texas Penal Code, knowingly delivering a controlled substance that results in death meets the statute’s requirements. The judge denied the motion, ruling that the statute is clear and constitutional, and that a jury could later determine whether Cormier knowingly delivered fentanyl.

Next, the court addressed Cormier’s motion to reduce bond, currently set at $500,000. Under oath, Cormier testified she could afford only about $100,000 with family assistance and agreed to GPS monitoring and drug testing if released. She revealed a prior burglary conviction for which she served prison time and completed parole in 2023. The prosecution highlighted that she was already in custody for theft when she allegedly smuggled drugs into jail, leading to another inmate’s death.

Given the serious nature of the offense, her criminal history, and the circumstances of the alleged act, the judge denied the bond reduction request, deeming the existing amount appropriate. The case was reset for a later announcement, pending a report from the defense’s expert expected in early June.
