Section 512 of the Pakistani Code of Criminal Procedure (CrPC) allows for the recording of evidence in the absence of an absconding accused person, but it does not permit a trial in absentia. Instead, Section 512 is a mechanism to preserve evidence against an accused person who has absconded and has no immediate prospect of arrest. This evidence, once recorded in the absence of the accused, can only be used against them later if their trial proceeds upon their arrest and the witness who gave the deposition is unavailable (e.g., deceased, incapable of testifying, or otherwise unreachable).
Purpose of Section 512
Preserves evidence:
The primary goal is to ensure that the statements of witnesses are not lost if the accused absconds.
Prevents abuse:
It prevents an absconding accused from taking advantage of their own act of fleeing by ensuring evidence can still be used against them.
Conditions for Applying Section 512
Abscondence of the accused: It must be proven that the accused person has absconded.
No immediate prospect of arrest: There should be no immediate possibility of arresting the accused.
Examination of witnesses: The court can then examine prosecution witnesses in the absence of the accused and record their depositions
