RESISTING ARREST

Under CRS 18-8-103, it is a crime in Colorado to resist arrest. Like it sounds, resisting arrest is when a person tries to thwart a police officer from carrying out an arrest. An example would be threatening the police officer with harm or physically fighting back against the police officer as he or she is trying to place cuffs on the suspect.

Resisting arrest is a class 2 misdemeanor, carrying up to $300 in fines and/or up to 120 days in jail. This is in addition to the penalties for any other crimes the defendant may have committed, such as assaulting the officer.

However, there are ways to fight resisting arrest allegations. Three potential defenses that could get the charges reduced or dismissed include:

1) The defendant was acting in lawful self-defense or defense of others;
2) The officer was using excessive force; or
3) The officer was not engaged in his or her official capacity, and a private citizen would have had no authority to arrest the defendant

Note that it is not a defense if the arrest itself was unlawful. As long as the police officer had a good faith belief there was probable cause to execute an arrest, the arrestee and everyone else must cooperate. Then later on they can voice their objections to a judge.
