It has been suggested (e.g. Lim 2001) that it was influenced by Arabic custom - the waqf – introduced into England following the Crusades.

Where a person wished to give property to persons who were unable to hold property in their own name - such as women and children - they would give the property to a man for the use of the women and children; or where they wished someone to perform and receive the feudal duties. Another example was where the recipient had taken a vow of poverty and could own no property.
