Summary:
Devon Atkins appeared in court for a probation revocation hearing related to her third-degree felony conviction for injury to an elderly individual, stemming from a case that began on May 23, 2022. She had previously pleaded true to Counts 4 and 5, and during this hearing, the court considered Counts 1, 2, 3, 6, 7, and 8 based on probation violations.
Probation Officer Miss Cole testified that Atkins repeatedly failed to report to probation, failed to provide her current address, and did not complete her community service obligations. Atkins also violated the court’s no-contact order with the victim, her grandmother. Despite being given multiple chances and resources, including mental health treatment referrals to Spindletop, Atkins refused to attend her appointments or take medication. Officer Cole emphasized that Atkins had been unmedicated throughout supervision, worsening her instability.
Atkins completed residential treatment and SAFPF but failed to complete aftercare programs, and missed mandatory drug/alcohol screenings on at least five occasions. Despite opportunities to comply, she remained noncompliant, citing confusion about the programs and claiming she was not mentally ill.
Her attorney argued that Atkins’s behavior was rooted in untreated mental health issues, not willful defiance, and that she could benefit from a specialized mental health probation caseload. However, the court noted that she had been found competent to stand trial earlier in the year and determined her failure to comply was a choice, not an inability.
Ultimately, the judge found Counts 1, 2, 3, 6, 7, and 8 true, revoked her probation, and sentenced her to five years in the Texas Department of Criminal Justice. Despite continued outbursts from Atkins claiming innocence, the court finalized the sentence and advised her of her legal restrictions going forward.
