As of September 1, 2025, Texas has passed new laws that place major restrictions on the marketing, advertising, and sale of vape products. If you vape — or sell vape products — you need to know what’s now illegal.

The new rules prohibit:

Cartoon, celebrity, or fruit-themed vape packaging that appeals to minors.

Vapes shaped like ordinary household or school items, such as highlighters, pencils, lipsticks, or phones.

Vapes manufactured in China or other designated foreign adversary nations.

Vapes containing banned substances, like THC or kratom, in addition to nicotine.

These changes do not affect possession laws: it’s still a Class C misdemeanor for anyone under 21 to possess a nicotine vape, and a state jail felony to possess a THC vape.
