An Ordinance Prohibiting the Parking of Over-Sized Vehicles

The proposed ordinance was recommended by Councilmember McShane in response to resident complaints about such vehicles being parked on the City’s roadways. Such vehicles create line-o-sight obstructions, thereby negatively affecting the safety of motorists and pedestrians. Recreational vehicles, in particular, also negatively affect the environment through the discharge of septic waste, wastewater, garbage, and trash into the City’s roadways, storm drains, and sewer drains. The proposed ordinance is intended to improve the public’s health, safety, and welfare by eliminating the negative effects such vehicles have on the community. The cities of Monterey, Seaside, Marina, Morgan Hill, and San Rafael, for example, have enacted similar ordinances for similar reasons.

It should be noted that such ordinances have been successfully challenged in other California jurisdictions, so the adoption of the proposed ordinance is not without risk. Salinas has in the past had a similar ordinance in place which prohibited the parking of recreational vehicles on City streets. The City did not successfully defend that ordinance on the basis that it did not post the appropriate signage warning of the parking prohibition. The proposed ordinance includes a requirement that the appropriate signage be posted in accordance with the California Vehicle Code before the prohibition may take effect.

A violation of the proposed prohibition can be cited either criminally, as a misdemeanor, or administratively pursuant to the existing provisions of the Municipal Code. Vehicles parked in violation of the prohibition are also subject to immediate removal, i.e., may be towed at the owner’s expense. The tow companies on the City’s rotational tow list would be called upon to assist with the removal of such vehicles; however, the tow companies have recently raised concerns with regard to the expense and the logistical challenges presented with the towing of over-sized vehicles. The City will need to resolve these outstanding issues prior to implementation of a removal program so that vehicles may be removed as needed.

CEQA CONSIDERATION:
The City of Salinas has determined that the proposed action is categorically exempt from environmental review pursuant to the California Environmental Quality Act (CEQA) pursuant to CEQA Guidelines section 15301 concerning the operation or minor alteration of existing public facilities involving negligible or no expansion of use.

STRATEGIC PLAN INITIATIVE:
This item is not among those on the City Council’s current Strategic Plan.

FISCAL AND SUSTAINABILITY IMPACT:
There is no impact on the City’s General Fund with the City Council’s consideration of this Administrative Report.
