When an employee does not get promotions, but other coworkers with similar training and experience do get promoted, and the employee has been passed over for promotion due to their protected status, such as their race, gender, religion, or sexual orientation, then they may be able to sue their employer for wrongful failure to promote.
Promotion discrimination is when an employer fails to give a promotion for improper reasons, or reasons that violated state or federal law.
There is a checklist of 4 basic concepts that could help prove a case for wrongful failure to promote. First, that you belong to a protected class because of your race, religion, sexual orientation, age, nationality, skin color, physical or mental disability, personal medical history, pregnancy, or gender and/or gender identity. Second, that you suffered an adverse employment decision such as not getting a raise or promotion. Third that your other co-workers who were not a member of the same protected class that you are a part of, were treated differently, perhaps they did get the promotion, or they get special privileges that you are not permitted. And finally that the decision to not promote you was based on your status as a member of a protected class.
Evidence that can back up your claim or wrongful failure to promote, include documents, emails, and text messages that show discrimination, such as comments about your protected class, or offensive jokes about your protected class. If you can show this evidence, then the burden shifts to your employer to prove that they did not discriminate against you.
