The importance of the British Electronic Communications Code 2017. The introduction of the reform of the Electronic Communications Code (ECC) in the UK aimed to improve the availability and capacity of communications, especially in the context of 5G technology. However, mobile operators took advantage of the new Code to reduce rents significantly, prompting property owners to react.

We are seeing more court decisions relying on the 2017 Code than in the three decades of the earlier Code, and the court has expressed concerns about delays. The government is considering possible changes, but legal organizations believe that amendments to the Code and procedures alone may not be enough.

Ofcom (a state body in Great Britain that controls and supervises the media and telecommunications market) suggests that the parties should strive to resolve conflicts by agreement, and Telecom Infrastructure Partners (TIP) believes that it can play a key role.

More than 25,000 land lease investments around the world prove that owners of land or facilities who allow their use by telecommunications companies are willing to accept additional lease fees. Many such payments have been made in the UK. As mentioned earlier, TIP is prepared to accept possible rent reductions in accordance with the new ECC. TIP's business model is based on long-term, predictable cash flows, similar to bonds, regardless of how possible changes will affect rents in the future. Our refund is not dependent on any negotiated "increases".

We do not take a position on the new ECC (Electronic Communications Code - ECC is the legislation governing new contracts between property owners and telecommunications operators regarding the installation and maintenance of communications equipment.), which allows us to be a neutral intermediary between land owners and mobile network operators and infrastructure companies.
