As per the apex court guidelines in Arvind Kejriwal’s bail order, he can hold office but can’t function as Minister. In the given situation, Centre, which approves govt formation in Delhi, is unlikely to give a go-ahead to Kejriwal becoming CM unless he gets relief from the Supreme Court and AAP wins majority in the upcoming Vidhan Sabha elections. In social scheme cases the possibility of FIR for fraud cannot be ruled out as there is a legal case for it.
