MUBARAK SANI CASE | Controversial Decision of Supreme Court of Pakistan

Soon after the Supreme Court Pakistan released the verdict, the whole religious community in Pakistan started rejecting it and calling it a very controversial decision which has undermined the Muslims of Pakistan.

Let us tell you all the important Mubarak Sani Case details.

Mubarak Sani was a resident of Rabwa city, located near Chiniot. The majority of the community is Qadiani.

Rabwa was the headquarters of the whole Qadiani community from 1948 to 1984. After that, it was shifted to Germany.

In 2019, a ceremony was held at Nusrat Jahan College in Rabwah, where Mubarak Sani distributed a controversial book, “Tafseer-e-Sagheer.”

This book was written by Mirza Mehmood Qadian, who was the elder son of Ghulam Ahmad Qadiani Yazedi.

This book contains derogatory elements about the most respected book of Muslims, “Quarn-e-Paak.”

So actually, this distribution led to the Mubarak Sani Case because, as per the Punjab Quran Shareef Act, writing, publishing, printing, or distributing any such derogatory book is a crime in Pakistan, leading up to three years of sentence in Jail.

This incident was reported soon after its occurrence, but it took almost three years for the final FIR (First Information Report) to be registered against this man, leading to the Mubarak Ahmad Sani Case.

In the FIR, he was tried against three different acts:

1). Quran Shareef Punjab Act
2). 295 B
3). 298 C

295 B law is against any such person who in any form disrespects the holy book of the Quran.

298 C law is especially for Qadianis and forbids these people to call them Muslims and preach their religion in any open or public place.

After passing all the lower courts, the Mubarak Sani case reached the Supreme Court of Pakistan in February 2024, where a three-member bench led by Justice Qazi Faez Isa heard the case and issued the Mubarak Sani case decision.

The court acquitted Mubarak Sani of all three crimes and mentioned that no crime had been found against the man in question.

The Supreme Court of Pakistan’s decision, written by Qazi Faez Isa, highlighted the following:

1). For Quran Shareef Punjab Act, it mentioned that Mubarak Sani couldn’t be tried under the particular point because it was added to the act in 2021, and he committed the crime in 2019.

2). For 295 B, the court mentioned that no such crime has been imposed on the criminal in the FIR.

3). For 298 C, the Mubarak Sani case highlights that he distributed the book in a college dedicated to the Qadiani community, where no Muslim was present.

Therefore, based on these findings, the Supreme Court of Pakistan acquitted him, and based on the Mubarak Sani case today news, there is no case against him.

All the religious parties took this decision very seriously and issued statements against the Supreme Court of Pakistan and Qazi Faez Isa.

They have mentioned that the court has not followed all the rules in this case and ignored many acts through which the criminal could be tried.

They mentioned the Mubarak Sani case decision as a conspiracy against Islam, leading to emotional damage to all Muslims.
