(20 Nov 2019) The American Civil Liberties Union on Wednesday asked a federal judge in Oakland to block President Donald Trump from using $3.6 billion in military construction funds to build a wall along the southern U.S. border.
The ACLU, which filed the lawsuit on behalf of Sierra Club and Southern Border Communities Coalition, claim that President
Trump is abusing emergency powers to obtain border wall funds that Congress denied.
"We were here today to ask the court to put a stop to that and make it so that they can't use any of that money to build this wall that Congress has not authorized it," ACLU staff attorney Dror Ladin said outside the courthouse after the hearing.
U.S. District Court Judge Haywood Gilliam is expected to issue a ruling sometime in the next few weeks, Ladin said.
The Trump administration identified the $3.6 billion in military construction funds when he declared a national emergency in February, following a 35-day federal government shutdown.
The same district court previously blocked the Trump administration from using $2.5 billion in funding to build the wall. The Trump administration appealed that decision to the U.S. 9th Circuit Court of Appeals, which heard arguments in the case last week.
