Former special counsel Jack Smith told members of Congress that the January 6, 2021 attack on the U.S. Capitol “does not happen” without Donald Trump, identifying the former president as the most responsible figure behind the effort to overturn the 2020 election. Smith made the remarks during a closed-door deposition with the Republican-led House Judiciary Committee in December, transcripts of which were released this week.
Smith said the evidence gathered during his investigation showed that Trump’s false claims of widespread election fraud fueled anger among supporters and directly led to the violence that left five people dead within 36 hours and injured more than 170 law enforcement officers. He argued the riot was foreseeable and that Trump failed to act to stop it once it began, despite repeated appeals from advisers.
Rejecting claims that the prosecution was politically motivated, Smith said the case was built largely on testimony from Republicans and Trump allies who placed loyalty to the Constitution above party politics. He maintained the evidence was strong enough to sustain a conviction.
Trump was indicted over his role in attempting to overturn the 2020 election, but the case was later dropped after his 2024 election victory due to Justice Department policy barring prosecution of a sitting president.
