How the Insurance Company Evaluates Your Case for Settlement

Settlements in Georgia workers’ compensation claims can be difficult to understand. First, you need to recognize that the insurance company does not have to settle your case. Further, the State Board of Workers’ Compensation cannot mandate that the insurance company pay you a lump sum.

Further, settlements in Georgia work injury cases do not include payment for pain and suffering. Instead, the settlement value of your case arises from negotiations about how much the insurance company may have to pay in the future for medical costs, lost wages, travel, other health care expenses and your “permanent partial disability” (#PPD) rating.

As I discuss in this video, the insurance company sees your case only in terms of how much money they will have to spend on you. They do not care about how long you have worked for your employer, nor do they care that you were a valued and well liked employee. Their only focus is “how do we make this case go away for as little as possible.”

Knowing how the insurance company approaches settlement negotiations will help you better prepare for the process, which may also include a mediation.
