Some who have nothing to hide aren’t as strict and understand what your asking for and release them to you without going thru AG’s office. For example in our county, the Wood County sheriffs office and the Quitman police department earned an A for quickly releasing public records requests. The Wood County District attorneys office is regrettably on the other end of the spectrum. Those grade A agencies are a very small percentage of the local government custodians of records, and we appreciate them very much.

If the county treats their own this way, imagine the way the everyday pesky citizens are treated.
This is an update on Mr. McBride’s ongoing saga of trying to get public records for over 6 months from Hopkins County Tx administration, and some tips on how to submit a Texas Public Information Act request.

I believe Kyle’s request was denied for the simple reason he asked for “memos” in the request. A simple mistake like this gets most Public Information requests denied. It’s a word game to our masters. The agencies know what Kyle was asking for but since he didn’t use the precise verbage, they can deny it. Maybe there were no “Memos.”

While I don’t believe there was NO footage of the arrest, maybe asking for all bodycam footage from date and hour of escape to date and hour of capture of a specific inmate from all officers within a specific agencys might turn up better results on your requests.
Must be extremely specific when requesting public records from some agencies!!

It might be best to go in person and have the custodian fill out the request. Let them ask what your looking for and them write it down. They will ask specific questions and you can answer them so less of a chance of your request will be denied due to a misunderstanding of what you wanted. The Texas Public Information Act allows requests to be taken by email, or in person and if you like, the custodian of records must dictate it for you on request, in case some citizens can’t write or understand English well.

Most state and local officials feel like they must release as little as possible and they deny as many as they can, asking the attorney general most of the time for their decision on whether records can be denied, adding months to the time records can be received.

One of the favorite denials from local officials will be under the umbrella of “the case is still under investigation.” When you get this reason for denial, it means the organization holding those records really doesn’t want the public to see them.

We have seen some law enforcement use this on a case that is 18 months old. How much more investigation do they need? These officials are just not wanting the video evidence to become public and using this reason for denial to keep it from the public for as long as possible which makes it difficult for people to make specific public records requests and adds more barriers you put up to getting the information!

Not very transparent!! Makes you wonder if these official have nothing to hide, why are they making it so tough to get these records that citizen have the right to access them?
But when the issue sheds good light on the department, they are quick to release video evidence of the incident. No attorney general decision is even asked for.
