R (Miller) v Secretary of State - the ‘Brexit case’ - was seen by many as a watershed moment. Critics have argued that the judiciary increasingly ventures into the political realm. Others, however, maintain it continues to operate within appropriate limits. This panel explores the relationship between the judiciary, the executive, and parliament under our modern constitution.
1. Rt. Hon.Lord Carnwath
Lord Carnwath is a former UK Supreme Court judge. He dissented in the Supreme Court case of R (Miller) v Secretary of State, arguing the courts should not question the adequacy of Parliamentary controls over the Executive.
2. Rt. Hon. Lord Faulks QC
Lord Faulks is a life peer, practicing barrister at 1 Chancery Lane, and former Minister of State for Justice. He recently led the Independent Review of Administrative Law, which culminated in the 2021 Faulks Report.
3. Sir Jeffrey Jowell KCMG QC
Sir Jeffrey Jowell is a practicing barrister at Blackstone Chambers and the inaugural Director of the Bingham Centre for the Rule of Law. He was formerly the UK’s member of the Council of Europe’s Commission for Democracy Through Law.
