PUBLIC NOTICE
Rebuttal by Hamdard Education Society (HES) to The Times of India Article Dated 23rd July 2025
This public notice is issued by the Hamdard Education Society (HES), the subservient society of the
sponsoring body of the Hamdard Institute of Medical Sciences and Research (HIMSR), New Delhi, in
response to the article published in The Times of India on 23rd July 2025, titled:
"Jamia Hamdard's 150 MBBS, 49 PG seats scrapped for 2025-26; CAG had flagged *813-crore
diversion."
The aforementioned article, based on statements attributed to Jamia Hamdard University, contains
material misrepresentations, factual inaccuracies, and misleading assertions that are detrimental to
the reputation and lawful functioning of both HIMSR and HES. In the interest of public accountability,
institutional transparency, and legal clarity, HES issues the following rebuttal:
1. Misrepresentation Regarding Withdrawal of MBBS and PG Seats
The article falsely claims that HIMSR's 150 MBBS and 49 PG seats were withdrawn due to regulatory
or financial lapses. The true and only cause of withdrawal is as follows:
• Unilateral withdrawal of affiliation consent by Jamia Hamdard University, communicated to
the National Medical Commission (NMC) on 6th June 2024, without prior consultation or
consent of HES or HIMSR.
• This action was undertaken during the pendency of court proceedings and in violation of the
Hon'ble Delhi High Court's directive to maintain status quo of HIMSR as on 20*h Sep 2022 .
• There is no communication or finding from NMC or MCC attributing regulatory or financial
non-compliance on the part of HIMSR.
2. Fabricated Allegation of 7813-Crore Diversion
The allegation of a 7813-crore diversion attributed to HIMSR is factually baseless, defamatory, and
malicious:
• The amount appears to have been misstated by Jamia Hamdard University as per their own
financial records, without HIMSR's knowledge or consent. HIMSR has never received or had
access to the CAG audit report that forms the basis of the article's claim. Actually, the
Sponsoring body has donated 426 crores for the establishment of HIMSR.
• All accounts of HIMSR are audited by the statutory auditors as required and also by the
internal auditors of international repute like Price Waterhouse Coopers (PwC)

• the audited financial statements of Jamia Hamdard for FY 2020-21, signed by its own Vice
Chancellor, Registrar and auditors, confirm that:
• HIMSR is a constituent institution;
• It maintains separate bank accounts;
• Funds are administered by HNF (MREC). A sub committee of the sponsoring body
Hamdard National Foundation (HNF), with no objections raised at the time.
Thus, the allegation of financial misconduct is entirely without merit and amounts to reckless
defamation.
3. Legal Recognition of HIMSR's Autonomy
HIMSR's autonomous functioning is governed by binding legal documents, notably:
• The MoA executed in 2021 by Jamia Hamdard, signed by the then and current Vice
Chancellor and also approved by Registrar of societies and UGC.
• Recognizes HIMSR as a constituent institution with academic, administrative, and
financial autonomy;
• Entrusts financial authority to the sponsoring body;
• Requires Jamia Hamdard to act only as the affiliating university until HIMSR attained
a u t o n o m o u s status.
• The Board of Management (BOM) irrevocable Resolution dated July 2021, signed and agreed
upon by Prof. Afshar Alam (as Chairman of the BOM), reaffirmed HIMSR's governance under
HES, and led to the opening of separate bank accounts under HES.
Any attempt to undermine or reinterpret these instruments retroactively constitutes to breach of
agreement and administrative misconduct.
4. Abuse of Administrative Authority and Due Process Violations
The actions undertaken by Jamia Hamdard University reflect serious overreach and abuse of
authority, including:
• Freezing of hospital accounts, thereby impacting critical healthcare services at the attached
hospital;
• Dissemination of false narratives, including unsubstantiated financial allegations, despite
HIMSR's transparent records and independent audits.
