Many husbands question how Indian courts can assume criminal jurisdiction when a couple married in India but left the country immediately and lived their entire married life abroad.

The Supreme Court’s interpretation of the Criminal Procedure Code allows a criminal case to proceed at the place where the complainant later seeks refuge. Based on this reasoning, Indian courts often continue criminal proceedings even when no part of the marital life or alleged cause of action arose in India.

As a result, the assumption that criminal cases can be avoided simply because the couple did not reside in India after marriage is incorrect.
