We have two rulings on the government's motions to unseal grand jury transcripts from the Epstein and Maxwell cases. The Southern District of Florida and the Southern District of New York have both denied the motions to unseal. In this video, I break down the Southern District of New York's order denying the government's request. Among other things, the Court found that the government's 3.5 page motion did not satisfy its burden of unsealing. Federal Rule of Criminal Procedure 6(e) governs when a court can unseal grand jury transcripts. In the Second Circuit, judges can also consider whether "special circumstances" exist beyond those enumerated in 6(e). Here, the Court found that there were no "special circumstances" warranting the unsealing because the Maxwell grand jury transcripts are mostly part of the public record already. The Court said these transcripts would reveal "nothing new" and refused to unseal them.
