Many people call us asking "How do I fire my DUI lawyer, and hire your firm?" This short video on firing a lawyer explains some aspects of this decision-making.

Our Atlanta office gets about 100 calls per year asking how to fire a lawyer handling their criminal case (usually a DUI in Georgia) and then hire us to finish the case. Georgia DUI courts at the misdemeanor level are usually fairly flexible with changes of defense counsel in criminal prosecutions, but not all judges will allow a late change when a case is if a felony and is scheduled on a published trial calendar. Furthermore, as a general rule, our success rate on cases that we are asked to take over is about 30% as good as our success rate when we handle the case from the beginning.

Changing lawyers is your RIGHT in a criminal case, so long as you do not wait too late. I have seen a DUI felony court judge in Fulton County refuse to allow a late change of attorneys, when he believed the motion for changing attorneys was being done to delay or avoid an upcoming trial.

Regardless of what your COURT does, we do not accept all GA DUI cases that come to us as a "Hail Mary" pass attempt, after the first Georgia DUI lawyer has done no meaningful work in the case. When key evidence is lost, and cannot be recovered or reconstructed for markings at the roadway (such as after an accident involving a vehicular homicide felony case).

Because we would lose well over 200 hours of file review time if we undertook to assess the chances of success in an old case, we have to charge a "second opinion" fee, but ONLY for cases that have already gone to the arraignment (first appearance). This second opinion fee is APPLIED against any fee we are quoting the person to handle the DUI trial in Georgia. Plus, we generally will have to charge our full fee for the case, due to the amount of "catch up" work we have to do, and possibly on an accelerated basis.
