Insurance Claim filed with American Family Insurance for dishwasher leak in December. Told if we used preferred vendor for repairs (Service Master of Salt Lake) that they could do billing direct with them and any damages caused by vendor would be fixed. Service Master of Salt Lake did demo wrong our kitchen floor (should have tested vinyl underneath tile once discovered before continuing). Instead they tore out the entire tile floor before testing the vinyl (it was positive for asbestos), left asbestos debris, did not properly contain the area and turned on high powered fans for a week. Their actions caused our entire house to be contaminated with Asbestos. They were cited/fined by the Utah Division of Air Quality (DAQ) in February. The DAQ also requires an approved plan for clean up (approved in Feb). Entire house, HVAC and garage contaminated. Waiting since Feb for anyone to step up to pay - noone has. American Family says there is no coverage in our policy because it is deemed as "faulty workmanship" by their vendor. Remember promises that preferred vendor equals ease with billing and protection with damages. Multiple written communications from American Family saying their vendor contract requires Service Master of Salt Lake to repair things. A Senior Policy Adjuster at American Family even told us in an email that they would file a Subrogation Claim against Service Master if they did not resolve. Subrogation means that American Family would handle the claim so we can move on and then sue Service Master themselves if needed but they have not done this. Service Master Corporate , their franchisee and Guide One (insurance for franchisee) all claim diligently working through claim but nothing done for 5.5 months. . The initial repair estimates are $151k but Guide One has offered less than that claiming they don't have to pay full value because that would be enriching us. They've also offered nothing for our personal property that has to be destroyed. They say we have to provide an inventory which isn't simple. The DAQ Project Design has specific requirements for dealing with the contents by licensed professional ($40k bill). We can't go in an do ourselves. Guide One expects us to front the $40k to obtain the inventory with no guarantee they will reimburse that expense or give us replacement value for the items. One person at Guide One verbally offered to pay the $40k after our Attorney sent a 2nd demand letter to all parties outlining all the shenanigans with the Guide One Adjuster but when it came time to memorialize the agreement in writing or issue a check the original adjuster became involved again instead. She decided that we had to start everything over (new lab results, new DAQ design, new estimates). Remember all has been done since February and all parties including Guide One have had the documents regarding all since then. American Family says that Guide One is resolving and until/unless they deny the claim there is nothing for American Family to do. American Family has also only approved our temporary housing every 4-6 weeks at a time so Air Bnb's wont work unless we want to move alot.

After being on the local news American Family decided to offer us a 6 month lease on a rental property. Guide One decided to drop their argument about reinventing the wheel with the process and went back to offering a low ball settlement that doesnt cover all of the home repairs or anything for our personal property that has to be destroyed. We continue to decline their settlement offers. A third party Administrator (TPA) for Service Master Corporates insurance sent our Attorney a letter with a claim number for QBE Insurance but no further information. The TPA has not responded to any requests about these matters.

***The icing on the cake....less than 2 weeks after being on the local news American Family sent a letter stating that they not be renewing our Home Owners policy. There are a variety of excuses for why but none are clear. We've been told that American Family has to complete whatever is needed with the open claim despite the non-renewal but we suspect additional damage to the home because it's been sitting for nearly 6 month now with water damage. The work needed for the asbestos contamination has to be done first per the DAQ Project Design and is estimated to take 8-12 weeks. and our policy will no longer be in effect to file an additional claim if there are new/additional problems found.
