Is it Compulsory to Pay Service Charge at Restaurants?

So what can you do if you are charged with “Service Charge” in a Restaurant?

#1 Tell them about this Guideline that they cannot make service Charge Mandatory

#2 If they still ask you to pay stating that they did mention it on the Menu Card or at the Gate; you can report the matter to the Consumer forum.

#NOTE! ⚠️ The guidelines issued by the Ministry of consumer affairs is only advisory nature and as such we don’t have any law regulating the imposition of service charge.

#BUT 🚫 The consumer forum and different courts do look upon the practice of mandatorily imposing “Service charge”

#TAKEAWAY ✅ So there is no definite law or legislation dealing with this and that’s why the confusion is still prevalent!😪 - But the Consumer Forum and Courts definitely discourage it by imposing penalties on Restaurant 🤠💯

💡 Also, did you know that the customer’s entry into the premises should not be considered as his/her consent to pay a fixed amount of service charge?
