Can my child support payment amount be changed?

Yes, if you can prove a substantial change in circumstances.

And there’s no minimum wait time between modifications

What would be considered a substantial change in circumstances?

When the new child support amount is 20% more than the old amount. Judges have discretion and aren’t required to follow this guideline, but it’s a good rule of thumb.

Extraordinary medical expenses not provided for or anticipated at the time child support was awarded

Changes in childcare costs

Changes in your child’s mental or physical condition

Financial changes, such as improved or decreased earning capacity, loss of job or promotion and a raise

Change in parenting time, where child support was based on how many “overnights” your child was with each parent

Termination of alimony

One parent has been called to temporary military service

Be aware that child support cannot be modified unless it is specifically requested in the pleadings.

“Automatic” modification clauses are not enforceable.

Child support cannot be modified retroactively; it is only retroactive to the date of filing

So... How do I do it?

To have a Child support order modified in SC, it must have been established in SC, or you must have your order domesticated (transferred from the state of origin)

Fill out the forms

File with the court

Serve the other parent

Request a hearing

Present at the hearing

That’s it! The judge will make a decision and issue an order.
