PAINESVILLE, OH – On New Year's Day 2023 at 3:40AM, a trooper with the Ohio State Highway Patrol pulled over a vehicle on the Lakeland Freeway that was unable to maintain their lane while traveling. While speaking to the suspect, the trooper observed him to have slurred speech and smelled an alcoholic beverage emitting from his vehicle. The suspect claimed that he was dropping a friend off at her house and that he had drank earlier in the evening. The trooper then asked the suspect to step out of his vehicle to which he obliged.

After patting the suspect down for weapons, the trooper administered a horizontal gaze nystagmus test on the suspect. While performing the test, the suspect repeatedly told the trooper that he had trouble following his finger, but was able to count the fingers on his hand with peripheral vision. The suspect eventually performed the test as instructed. The trooper observed lack of smooth pursuit, onset of nystagmus prior to 45 degrees, and distinct and sustained nystagmus at maximum deviation in both eyes.

After being instructed on how to perform the walk-and-turn test, the suspect stopped during his first attempt to remove risers from his shoes. During the second attempt, the suspect turned incorrectly, stepped off line, raised his arms six inches for balance, performed the incorrect number of steps, stopped walking to steady himself multiple times, and did not touch heel-to-toe on three separate steps. For the one leg stand test, the suspect swayed while balancing, put his foot down, and raised his arm for balance.

The suspect failed to properly recite the alphabet starting with the letter "D" and stopping at the letter "Q." The suspect then consented to providing a preliminary breath alcohol sample which yielded a result of .300% breath alcohol content. The trooper then arrested the suspect for operating vehicle while under the influence, or OVI, and was transported him to the Lake County Sheriff's Office for further processing.
