In this video, we explain the real confusion and injustice created after the Promila vs State of Haryana case and how inconsistent implementation by HPSC is affecting both General and Reserved category candidates.
🔹 What the High Court said
The High Court clearly held that reserved category candidates should get the benefit of reservation.
If a reserved category candidate qualifies on general merit, they should be adjusted against general seats, so that reserved seats remain available for other category candidates.
🔹 What the Supreme Court said
Later, the Supreme Court stayed the High Court order and directed that:
Selection should be made strictly on merit,
Top merit candidates must be given preference, irrespective of category,
Final merit should be prepared accordingly.
🔴 The Core Problem
Because of this situation:
Reserved category cut-off is going higher than General cut-off, which is completely illogical.
At the first stage (screening exam), reserved category candidates are not getting any real benefit.
HPSC is following the High Court order in one recruitment and Supreme Court order in another, creating total inconsistency.
As a result, both General and Reserved category candidates are suffering injustice.
✅ Simple & Practical Solution (Ignored by HPSC)
A very simple solution exists but is being ignored:
👉 If extra candidates equal to the number of reserved category candidates likely to move to General merit are allowed to qualify for the second stage,
the entire issue can be resolved without violating any court order.
This would:
Protect General category candidates
Ensure real benefit to Reserved category candidates
Maintain fairness and transparency in the selection process
❗ Serious Concern
Unfortunately, such a basic and logical solution is not being implemented, raising serious questions on decision-making at the top level.
It is surprising that such a straightforward issue is still not being understood or addressed by the authorities.
