Do you dream of launching a U.S. business and relocating to America?

If so, the E2 visa may be right for you, and there's never been a better time to apply.

To be eligible, you must meet the following 7 requirements:

1. Citizenship of a Treaty Country

You must be a national of one of approximately 80 treaty countries, including Canada, the UK, Italy, Germany, France, Mexico, Japan, Australia, and many others.

2. Substantial Investment

You must have invested a substantial amount of capital in a bona fide U.S. business. While there's no fixed minimum, investments typically need to be at least $100,000.

3. Bona Fide Enterprise

Your U.S. business -- which can be a startup, a franchise, or an existing one that you purchase -- must be a real, active, for-profit enterprise that produces goods or services. It cannot be a passive investment such as real estate or stock investments.

4. At-Risk Investment

Your invested funds must be at risk—that is, spent, not just sitting in a business bank account -- and subject to potential loss if the business fails. The funds must also be legally acquired and under your control.

5. Direct and Develop the Business

You must be coming to the United States to actively direct and develop the business. This typically means owning at least 50% of the enterprise and/or having operational control through a managerial position.

6. Not Marginal (Small)

Your U.S. business must not be marginal, meaning it should generate more than enough income to provide a minimal living for you and your family and/or have a significant economic impact in terms of job creation and otherwise

7. Intent to Depart

You must state your intention to leave the United States when your E2 visa status expires, even though your E2 visa -- which is typically issued originally for up to 5 years -- can be renewed indefinitely as long as the business remains viable.

With an E-2 visa, you can legally live and work for your own business in the United States, bring your spouse (who can also work in the U.S.) and your unmarried children under 21, and, as noted previously, renew it indefinitely as long as your business continues to operate and grow.
