Good morning, everyone. This is Douglas Cohen with Peak Legal Services, LLC.
I’m here at the Colorado Department of Motor Vehicles Hearing Division where hearings occur on revocations of driver's licenses.
In this particular case, a revocation proceeding occurred on my client’s license involving a DUI arrest. These are very important hearings for attorneys to attend and fight for the client because sometimes you can win. It doesn’t happen very often, but it happened today.
In this case, the officer failed to appear. It is the government’s obligation and law enforcement agency’s obligation for the officer to appear and prove their case. If they don’t do so, then the driver gets to maintain his license.
So it’s very important to follow through with these and advise your client appropriately on how to proceed with these hearings.
