It provides a framework for States to develop strategies, monitor performance, and continuously improve their implementation of international maritime regulations.
Resolutions and Objectives:
• Resolution A.1070(28):
This resolution adopted the III Code as a standard for IMO Member State Audits.
• Objective:
The core objective is to enhance global maritime safety, the security of ships, and the protection of the marine environment.
General Requirements:
• Develop a Strategy:
States should develop an overall strategy to fulfill their obligations and responsibilities as a Flag, Port, and Coastal State.
• Establish a Methodology:
A methodology is needed to monitor and assess the effectiveness of the strategy in implementing and enforcing relevant international instruments.
• Continuous Review:
The strategy should be continuously reviewed to improve overall performance and organizational capability.
Requirements of Flag, Port, and Coastal States:
Flag State:
• National Legislation:
Flag States need to adopt national laws and regulations to give effect to IMO instruments they have joined.
• Implementation and Enforcement:
Flag States are responsible for ensuring their flagged vessels comply with international regulations.
• Monitoring and Reporting:
Flag States need to establish systems for monitoring compliance and reporting to IMO on their performance.
Port State:
• Port State Control (PSC):
Port States are responsible for inspecting foreign ships in their ports to verify compliance with international regulations.
• Detention and Action:
Port States can take appropriate administrative measures, including detaining vessels that do not comply with international regulations.
• Enforcement:
Port States should ensure the effective enforcement of international regulations through PSC.
Coastal State:
• Protection of the Marine Environment:
Coastal States have a responsibility to protect the marine environment within their jurisdiction, which includes enforcing regulations related to ship-source pollution.
• Response to Emergencies:
Coastal States should have procedures in place for responding to marine pollution incidents and other maritime emergencies.
• Enforcement:
Coastal States should have the capacity to enforce regulations related to maritime safety and environmental protection.
