WHO CAN BE ARRESTED FOR "POSSESSION OF NARCOTICS" IN NEVADA?

It is a crime in Nevada to knowingly possess controlled substances for personal use. It does not matter even if it is a very small amount of drugs. Possession of any amount of narcotics invites prosecution in Nevada.

NRS 453.336 prohibits possession in Nevada of all types of narcotics including cocaine, meth, heroin, GHB, and ecstasy. Nevada law also prohibits possession of prescription drugs without a valid prescription such as Xanax, Ritalin, Vicodin, and Ambien.

DIFFERENT TYPES OF "DRUG POSSESSION" IN NEVADA

Nevada law prohibits all types of drug possession for personal use. This includes actual, constructive, and joint possession:

• Actual possession of drugs in Nevada is carrying drugs on your physical person such as in your hand, in your backpack, or in your pocket.

• Constructive possession of drugs in Nevada is having drugs in places where you control, such as your home, car, or a safe. Therefore a person may be charged with drug possession even if the drugs are very far away from where the person physically is at the time of arrest.

• Joint possession of drugs in Nevada is sharing control of drugs with at least one other person. It is common in Nevada for multiple people to be charged with possession of the same drug.
