From this video I will learn how an Accussed can obtain certified Copy Of First Information Report from Police.

Can Accused obtain certified copy of F.I.R.
When an First information Report has been lodged by the complainant and registered before the concern Police Station , The accussed required copy of F.I.R. for many purpose like
A. to know under which offence the F.I.R. has been registered agasint him
B. to obtain anticipatory bail , in case it is a Non Bailable offence
C. to contest the F.I.R. by filing the 482 Pettiion, in case it is a false Report.
what police used to do ;=-
1. Point No.1. :- Accused required the copy of the First Information Report so that he may come to know that under what offence the First Information Report has been registered .

weather it is a Bail Able offence or Non Balable offence.

If it is a Non -Bailable offence, he can apply for bail. for anticipatory Bail or for regular bail.

If it is a Bailable offence, he can save himself from the torture of the police since the police officer cannot arrest him. and seek regular bail from the concern Magistrate.

2. Point No.2.:- Police only used to call the accused or went for his arrest

3. Point No.3:- Police does not disclose that under what sections the First information Report has been registered ,Because of the fact that if the offence is Bailable offence, the police wants some from the accused so instead of disclosing the fact , they used to call the accused. Threaten the accused. Does not provide the copy of the First Information Report to the accused.

Important Direction issued by Hon'ble Supreme Court: =
1. An accused is entitled to get a copy of the First Information Report at an earlier stage than as prescribed under Section 207 of the Cr.P.C.

2. An accused who has reasons to suspect that he has been roped in a criminal case and his name may be finding place in a First Information Report can submit an application through his representative/agent/parokar for grant of a certified copy before the concerned police officer or to the Superintendent of Police on payment of such fee which is payable for obtaining such a copy from the Court. On such application being made, the copy shall be supplied within twenty-four hours.


3. Once the First Information Report is forwarded by the police station to the concerned Magistrate or any Special Judge, on an application being filed for certified copy on behalf of the accused, the same shall be given by the Court concerned within two working days. The aforesaid direction has nothing to do with the statutory mandate inhered under Section 207 of the Cr.P.C.

4. The copies of the FIRs, unless the offence is sensitive in nature, like sexual offences, offences pertaining to insurgency, terrorism and of that category offences under POCSO Act and such other offences, should be uploaded on the police website, and if there is no such website, on the official website of the State Government, within twenty-four hours of the registration of the First Information Report so that the accused or any person


5. Obtaining Online:- The accused should first try to obtain online report if the report is being instituted on the portal. and check weather the report has been uploaded or not.
6. Obtaining from Police Station :-Thereafter the representative/ relative/advocate of the accused should go to the police station and submit an application and deposit the fees. But there is rare possibility that the police officer will provide the copy of the First Information Report.

7. Obtaining from Magistrate Court ;- Thereafter the accused should go to the concern magistrate court. Within next 24 hours the police is required to send copy of the First Information Report to the concern Magistrate in which jurisdiction the police station is lying.

8. Filing application for certified copy:- The accused should file application for obtaining certified copy of the First Information Report . After applying the accused should deposit the requisite court fees and obtain the certified copy of the First Information Report.
