The last 2 months have created a lot of panic in the tax planning world. Tax proposals released on September 13, 2021 would have created sweeping changes to the tax treatment of grantor trusts, while potentially reducing the estate and gift tax basic exclusion amount.


However, tax proposals for the Build Back Better Act which were released on October 28, 2021 appear to exclude these sweeping proposals. There are, however, some key changes affecting the income tax treatment of nongrantor trusts, including a new high earner tax, an elimination of the 100% exclusion of gain for qualified small business stock (QSBS) held by an estate or trust, and an expansion of the net investment income tax to include trade or business income not distributed by a trust or estate.
