Hi everyone!

It’s time for another tax tip. We are focusing on construction in Texas in this tax tip. One of the first things business owners must do when determining their sales and use tax responsibilities is understand the laws, rules, and definitions of the jurisdiction where they are doing business and how they apply to them.

If you are a contractor or subcontractor with construction projects in Texas, there are several factors that you must determine to understand your sales and use tax responsibilities. One of these factors is property type.

There are two types of property in Texas: residential property and commercial property. These are terms defined by the Texas Comptroller of Public Accounts (i.e., the taxing authority in Texas). You must understand these defined terms and categorize your job correctly. That is one of the first steps towards determining when or if you should charge your customer sales or use tax. It will also help you determine when you should pay sales or use tax on your purchases.

Once you have established whether you are working in residential property, commercial property or a combination of the two, you must determine the contract type and whether the project is for a tax exempt entity. Answering those questions will help you determine your sales and use tax compliance requirements.
