Kesavananda Bharati Case: Basic Structure of Constitution:
The Supreme Court’s 1973 judgment in the Kesavananda Bharati case, in which the Supreme Court laid down the “basic structure” doctrine on the limits of Parliament’s power to amend the Constitution, completes 50 years on Monday. The case, Kesavananda Bharati vs State of Kerala, was heard by a 13-judge bench of the Supreme Court. In 1973, the 13-judge bench concluded with a 7-6 majority that the Constitution’s ‘basic structure’ is inviolable and cannot be altered by the Parliament.
