The Affidavit of Support (Form
I-864) is a legally binding
document central to family-based immigration cases, ensuring that the intending immigrant does not become a public charge.
Form I-864 creates a legally enforceable contract, obligating the sponsor to provide financial support if necessary. This obligation continues until the immigrant becomes a U.S. citizen, earns 40 work quarters (10 years), leaves the U.S. permanently, or passes away.
Divorce does not terminate this obligation.
If the primary sponsor's income does not meet the required threshold (125% of the Federal Poverty Guidelines for their
household size), a joint sponsor can step in. Ensure that the joint sponsor understands they bear the same legal responsibilities as the primary sponsor.

If income alone is insufficient, sponsors can use assets to meet the requirement. Assets must be readily convertible to cash within one
year and valued at five times the shortfall amount for most cases (three times if sponsoring a spouse or child aged 18-20).
The Affidavit of Support is more than a form; it's a long-term
financial commitment. Ensuring that sponsors and joint sponsors understand their responsibilities, correctly calculating household size, and preparing for potential legal obligations can prevent complications and safeguard the success of your case.
