Aircraft Rule 135(4) of the Aircraft Rules, 1937 of India empowers the Director General of Civil Aviation (DGCA) to take action against airlines that establish excessive or predatory tariffs or engage in oligopolistic practices. This rule gives the DGCA the authority to issue directions to such airlines to ensure fair and reasonable pricing. 

Key Aspects of Rule 135(4):

Excessive or Predatory Tariffs: 

The DGCA can intervene if an airline charges abnormally high fares that are deemed unfair or aimed at eliminating competition. 

Oligopolistic Practices: 

The rule also addresses anti-competitive behavior by airlines, such as forming cartels or engaging in practices that limit market competition. 

Directions to Airlines: 

If the DGCA finds an airline in violation, they can issue orders and directions to rectify the situation and ensure compliance with fair pricing. 

Tariff Regulation (Rule 135(1)): 

This rule operates in conjunction with sub-rule (1), which requires airlines to establish a tariff considering factors like operating costs, service characteristics, and reasonable profit. 

Market-Driven but Regulated: 

While airfares are largely market-driven, Rule 135(4) provides a regulatory safeguard against abusive pricing and monopolistic behavior. 

DGCA's Role: 

The DGCA's Tariff Monitoring Unit monitors airfares to ensure airlines adhere to declared fare ranges.
