RESTITUTION OF CONJUGAL RIGHTS AND LEGAL PROTECTION

When a couple is going through a tough phase in their marriage and the wife has left the matrimonial house, the husbands are generally advised to file the Petition under Section 9 of the Hindu Marriage Act, 1955 for Restitution of Conjugal Rights. They are told that this petition will protect them from the upcoming cases of Maintenance, 498-A and Domestic Violence. But, is section 9 really a safeguard?
The answer is NO. Restitution of Conjugal Rights means regaining the companionship of the Partner who has left your company without any reasonable cause and this petition only clarifies your intention of saving your marriage and doesn’t protect you from any counter cases filed by your wife. Hence, it should only be filed if you are really willing to reconcile with your partner because practically, it will not protect you from any counter cases.
