In Part One of Law and Freedom, we looked at the crisis of authority in the West and how treating absolute freedom and equality as goods in themselves actually creates the opposite, less freedom, as well as an increasingly powerful and distant autocratic state. This time we will look at the main values ONCE understood to be expressed in the concept of “Legal Freedom”. We look at the distinction between “positive” and “negative” freedom. Negative freedom is concerned with organizing a society in such a way that despite the imposition of a multitude of legal restraints to action, the state still left the citizen with a sufficiently large sphere for individual choice and initiative to be able to pursue the good life. Positive freedom was once seen as more of a "spiritual conception", what the individual was doing in his inner life to maximize his self-realization. In the video, we look at how the activitist state, pressing its program of radical egalitarianism while our elites pursue their self and esoteric interests has made positive freedom and substantive equality, a zeitgeist of our times. We also see the state increasingly interested in examining the inner lives of its citizens through hate crime legislation in pursuit of unacceptable ideas, and stomping out "imprudent" behaviour, all in the context of a "Westphalien state" that is now more myth than reality. We also look at the classical versus the modern progressive view of freedom. We will see the erosion of freedom of contract, right to property, and freedom of religion, association and speech under the modern conception of liberty. The paradox that law is in fact essential to freedom can, it is suggested, only be resolved through a return to a more classical conception of freedom, that we have a purpose or telos and that there are limits on the state imposed by objective goods, as well as custom and tradition. The other thing we need is to get the legal system to produce real jurists again, to be true guardians of the law and freedom, and not mere activitists and protectors of the state and globalist interests.
