Former CJI U.U. Lalit, speaking at the Supreme Court Bar Association lecture on “BNS 2023 & IPC 1860: Continuity, Change and Challenges”, traced the history of Section 124A (sedition) — from Tilak’s trial, the Kedarnath Singh case, to its eventual replacement under the Bharatiya Nyaya Sanhita (BNS 2023).

He explained how sedition has been redefined as Section 152 of BNS, aligning with the Kedarnath principle that criticism of government policy is not a crime unless it incites armed rebellion.

Justice Lalit also raised concerns on:
⚖️ BNS not making rape gender-neutral as to victims.
⚖️ Unclear framework for community service punishments.
⚖️ The need for a more consistent approach in drafting criminal law reforms.
