Over Booking is when the number of passengers, with confirmed bookings and who have reported for the flight well within the specified time ahead of flight departure, is more than the number of seats available.

According to the Passenger Charter of the Ministry of Civil Aviation, if the flight is overbooked, the airline must first ask for volunteers to give up their seats so as to make seats available for other booked passengers to travel on the flight.

For volunteers as well as the people who are denied boarding, the airline arranges for an alternate flight. If the alternate flight is scheduled to depart within 1 hour of the originally scheduled departure time, you cannot hold the airline liable for any compensation for the missed original flight.

However, if the airline fails to arrange for an alternate flight scheduled to depart within 1 hour of the originally scheduled departure time, then the airline is liable to pay:

1. 200% of booked one-way basic fare plus airline fuel to a maximum of Rs. 10,000, if the alternate flight is scheduled to depart within 24 hours of the booked scheduled departure.

2. Booked one-way basic fare plus airline fuel charge, subject to a maximum of Rs. 20,000, if the alternate flight is scheduled to depart more than 24 hours of the booked scheduled departure.

3. Refund of full value of ticket and compensation equal to 400% of booked one-way basic fare plus airline fuel charge, subject to a maximum of Rs. 20,000, if you do not opt for alternate flight.

We understand that it might be difficult to prove that the airline has denied someone boarding due to overbooking, but if you do face such a situation know your rights and file for a compensation.
