Описание к видео The Trial of the Juntas: rewriting the history of international criminal law

LSE Law and Matrix Chambers seminar series public lecture

In 1985, two years after the collapse of the military dictatorship in Argentina, the ousted military leaders were tried by the country’s domestic judiciary in a trial that became known as the “Trial of the Juntas”. The Trial’s scale and ambition –judging the three military “juntas” that had ruled the country for seven consecutive years- made it unique in its time. It shared several characteristics with modern international criminal trials: it was testimonial, victim-focussed and self-conscious about its role as history-maker and it tried crimes that we now call crimes against humanity.

To what extent has the Trial of the Juntas contributed to the emergence of transitional justice and the development of international criminal law? Luis Moreno Ocampo, having served as Deputy Prosecutor of the Trial of the Juntas and, twenty years later, as the first Chief Prosecutor of the International Criminal Court, will present his views on this question. Professor Ruti Teitel, whose path-breaking book Transitional Justice (Oxford University Press, 2000) was inspired by the Trial and the dilemmas resulting of Argentina’s transition out of the military regime, and Gerry Simpson, leading expert in the history and role of international criminal law, will also address this question and discuss Moreno Ocampo’s arguments.

Luis Moreno Ocampo (@MorenoOcampo1) is an Argentine lawyer and first Prosecutor of the International Criminal Court.

Gerry Simpson is a Professor of International Law at LSE.

Ruti Teitel (@rutiteitelis) is Ernst C Stiefel Professor of Comparative Law, New York Law School.

Chair: Devika Hovell is an Assistant Professor of Law at LSE.

Recorded on 5 May 2016 in the Shaw Library at LSE.
