In individual has died and you want to know whether a Will exists. I am Darren Findling of The Probate Pro. And we get asked this question a lot. Is there a central depository, a central place, where all peoples wills are recorded and filed? The answer is no. Because are so many places that an individual can store their will so for example often many people of an older generation would use safe deposit box at financial institutions these safe deposit box are not quite as popular as they used to be many people have their own safe or lock boxes within their own homes and often those types of important documents are stored there another logical place to look would be the attorneys office that may have drafted the estate plan if an attorney was used they often keep copies of it and very few but some do keep the original most lawyers don't like to do that but often will record notes in the file when they've asked the client where they intend to store their estate plan it's a good place to start of course there's so many places that people could store there will whether it's under the mattress in a file cabinet or otherwise you have to do a little bit of due diligence but there's no one place fits all for everyone that creates a will now there is another place that is a common storage place which is at the probate court in which the county in which the individual resided or is domicile most of the probate courts have a function in which you can record and store the will now during that individuals lifetime the recording and storing of that will is confidential information meaning you can't go and view somebody as will that has been recorded there it's simply confidential but following death a probate court will authorize you to view the will upon providing certain information including the death certificate so if you are stuck and can't find that will going to the probate court in which the individual was domicile maybe another logical location to search and what do you do if you just simply can't find the will of an individual that you're pretty certain well first you've got it turn over many stones keep looking but ultimately if you've got a copy of the will that may be admissible in probate under certain circumstances if you got questions regarding how to find a will how to probate a will how to administer a probate estate give us a call (833) PROBATE or visit us at TheProbatePro.com.
