What is lewd or lascivious molestation?
(a) A person who intentionally touches in a lewd or lascivious manner the breasts, genitals, genital area, or buttocks, or the clothing covering them, of a person less than 16 years of age, or forces or entices a person under 16 years of age to so touch the perpetrator, commits lewd or lascivious molestation.
- No person shall willfully and lewdly commit any lewd or lascivious act upon or with the body, or any part or member thereof, of a child under the age of 16 years, with the intent of arousing, appealing to, or gratifying the lust, passions, or sexual desires of such person or of such child.
- If convicted of third degree felony lewd or lascivious molestation include a minimum of three (3) years in prison, and a maximum of 15 years in prison.
- Possible sentences range from life in prison to 15 years in prison as well as sex offender probation.
- Face felony charges in the third degree, including prison terms between 10 and 16 years, fines up to $5,000, and mandatory lifetime sex offender registration.
