CONTEMPT OF COURT

We all know from TV legal dramas that judges can find people “in contempt of court” for deliberately disobeying or disrespecting the court. But many people don’t know the difference between criminal contempt and civil contempt in Colorado.

Criminal contempt is typically when someone in the courtroom talks back to the judge or speaks out of order. The penalties for being held in criminal contempt may include jail, fines, or both.

In contrast, civil contempt typically refers to when a party defies a court order, and this defiance harms the other party in the case. A classic example is one parent not paying court-ordered child support to the other parent.

In these civil contempt cases, the harmed party would ask the court to find the offending party in either remedial contempt or punitive contempt.

Remedial contempt is when the judge imposes fines or jail to encourages the offending party to abide by the court's demands. This sentence would lift as soon as the offender proves he or she is complying with the court, such as by being up to date on child support payments.

Meanwhile, punitive contempt is when a judge imposes a penalty such as fines or jail for the sole purpose of punishing the offending party for disobeying the court. This sentence stands even if the offender eventually complies with the court’s orders.
