The birth of a baby is a sacred, beautiful moment. But for some families, that joy is replaced with confusion and worry when their child is born with an injury. You're left with so many questions: "What happened?" "Was this normal?" "Could it have been avoided?"
Here at LawMD, we understand those questions on a very deep level. That's because our lawyers are doctors too. For us, birth injury cases aren't just legal puzzles; they are medical ones. We have seen firsthand that a birth injury is defined by what happens during or around the time of birth, but the cause of that injury often begins long before the delivery even starts.
Today, we want to talk honestly about this. We want to show you why looking at prenatal care—the care a mother and baby receive before birth—is so important. We'll also explain why a doctor's decision about how to deliver a baby is one of the most critical parts of preventing birth injuries. We can look at these cases in a way that regular practicing lawyers would have a hard time achieving.

What are Birth Injuries and How Do They Happen?
A birth injury is any harm a baby suffers during pregnancy, labor, or delivery. It's a sad truth that some of these injuries are a result of medical mistakes or carelessness.
Here are some of the common birth injuries we see:
● Brachial Plexus Injuries: These happen when the nerves in a baby’s neck and shoulder are stretched or damaged during delivery. This can cause weakness or even paralysis in the baby’s arm and hand. One of the most common types is called Erb's Palsy. These injuries occur in about 1 to 3 out of every 1,000 births. (Source: Boston Children's Hospital).
● Cerebral Palsy (CP): This is a lifelong condition that affects a child's movement and muscle control. It is often caused by a lack of oxygen to the baby's brain (hypoxic-ischemic encephalopathy or HIE) during the delivery process. HIE affects about 1 to 2 out of every 1,000 live births.
● Bone Fractures: A baby's collarbone (clavicle) is the most common bone to break during a difficult delivery. It happens in about 0.2% to 4.5% of deliveries.
● Brain Bleeds (Hemorrhages): Bleeding inside a baby's skull can cause serious, permanent brain damage.
These injuries are terrifying, but many of them are preventable. That's where a lawyer who is also a doctor brings a unique perspective.

The Big Decisions: Why Prenatal Care and a Doctor's Delivery Plan Matter
When we look at a birth injury case, we don't just look at what happened in the delivery room. We go all the way back to the prenatal care—the doctor's visits that happened in the days and weeks before the delivery. A lot of the time, the problem began long before the actual birth process.
1. The Problem of a Large Baby (Fetal Macrosomia)
One of the biggest risk factors for a birth injury is when a baby is too big to be delivered safely through the birth canal. This is a condition called fetal macrosomia, which means the baby weighs over 8 pounds, 13 ounces. A large baby can get stuck during delivery, especially their shoulder. This is called shoulder dystocia, and it's the number one cause of brachial plexus injuries and Erb's Palsy.
● A Less Talked About Stat: Did you know that while a large baby is a clear risk factor, doctors and hospitals often fail to recognize it in time? A study found that half of all brachial plexus injuries occurred even when there were no known risk factors for shoulder dystocia, showing that in many cases, a doctor's lack of preparedness or poor management caused the injury.
